regulation to prohibit smoking in enclosed places
On
November 25, 2003
, the Genesee County Board of
Commissioners approved a Regulation to Prohibit Smoking in Enclosed Places which
becomes effective on
February 23,
2004
.
The regulation builds on regulations which have been in place since 1994
by prohibiting smoking in nearly all worksites such as manufacturing plants,
offices with more than one employee, gas stations and convenience stores.
Worksites may construct separately ventilated, designated smoking areas.
Smoking continues to be banned in public places.
Existing bowling alleys and racetracks are exempted; however, any new
bowling alleys and racetracks must have separately enclosed, separately
ventilated smoking and non-smoking areas. Bingo
halls, which were previously exempted, will be expected to provide separately
enclosed, separately ventilated smoking and non-smoking areas.
Bingo halls not currently in compliance have one year to comply with the
new standards. Food service
establishments (restaurants and bars) must continue to comply with state laws
concerning smoking.
Businesses
must create and distribute a written policy.
Enforcement is complaint-based and complaints can be referred to the
Genesee County Health Department. The
first violation will consist of a warning citation.
Additional violations include:
- $100 for a second violation within one year from the
first violation;
- $500 for a third violation within one year from the
first violation;
- $1,000 for each additional violation within one year
from the first violation.
